Have you seen posts about new HOA laws on your Facebook timeline? It’s true that Texas REALTORS®️ helped advance legislation at the Texas Capitol last session that reformed HOAs to favor private property rights. However, these posts were mistaken about the date the law went into effect.
All but one of the provisions of that law went into effect in September 2021. (The other provision was effective December 1, 2021.) The law that passed through the Texas Legislature in 2021 had numerous provisions including expansion of homeowners’ ability to erect perimeter fences in HOAs; it prohibited HOAS from restricting the display of religious items on their property; and it increased transparency of decision making by HOA boards.
The law, authored by Sen. Brian Hughes (R-Mineola) and carried through the Texas House by Rep. Chris Turner (D-Grand Prairie), received bipartisan support. This is just one example of the influence of Texas REALTORS®️ at the Texas Capitol!

Why it’s your home ! Why should anyone tell you what to do and not to do on your own property that you’re buying? Now I do agree with making sure that the property keeps its value and people are nice and neat about it not having junk cars and bringing in trash cans but don’t tell me what I can and cannot do on my property
To T Mendez–Telling you to not keep a collection of junk cars on your lawn is in fact telling you what you can and cannot do on your property. Make up your mind, you can’t be both for and against regulation.
Then read the HOA restrictions before closing. If fences are restricted or regulated, it normally requires an HOA change in documentation.
I agree with you too. T Mendez. Resident not allow live in messy/dirty/ bad looking around outside their property- yes that is right , but HOA also no power to control anything else to resident what do, what not do – it is not America

I do not like front yard fences. I think it takes away from the curb appeal, especially if the front yard is small.
So don’t get a front yard fence. It’s not your business if your neighbor wants one though.
Seriously !!! I’ve had a car broken into and once I forgot my keys in it and they stole my keys !! Neighbors kid breaking off beautiful rose blooms and little trash in my yard that’s not our trash where I’m disabled and I don’t think it’s right that I’m constantly cleaning up my yard when it’s not my trash !!! I plan on putting up a security and privacy fence and why not I didn’t buy my home for others to ruin !!!
Then why aren’t they being enforced.
The biggest difference among HOA’s is compliance in my opinion; too lax and things unravel, too strict and people feel they are living in a restrictive regime. Who manages compliance and how is a challenge.
That is a question for your HOA board. I am sure you attend all HOA meetings… so speak up at the next meeting.
Thank you Texas Realtors for your constructive effort to benefit the public. This should be your purview rather than past efforts of disseminating unsubstantiated reports of structural bias. Best to have evidence before making those claims against anyone and particularly against those who pay your dues.
I live in an HOA… we have small lots here. WHAT could possibly be the reasoning entire perimeter fencing is now allowed ?? Any idea how BAD that can look??? 4-5-6 lined up? All different? It will look like a fortress?!?!

I’m guessing the issue you raise (different type fencing) can be handled with standardization of fencing – and allow “HOMEOWNERS” to enjoy their “PROPERTY RIGHTS”. BTW: HOA’s have NO VESTED interest in ownership (don’t pay the mortgage, taxes, cut the grass, do repairs or pay insurance), they are formed to “POLICE” (the main rub with most folks) their neighbors and have (and still do), cause more problems than they solve, i.e., Attaching liens (?). The need to roll back their assumed, acquired and restrictive “authority” is way overdue, and more work is needed to restore homeowner rights regarding HOAs.
I agree with you. These HOA’s are out of control. The American Dream of home ownership is a long lost concept because these HOA’s are worse than landlords.
A neighbor like mine who allowed a 6′ spill of white paint on her driveway for over a year and never put her trash cans away could cause sellers to lose buyers and cause them to lower their price. This affects the value of every home around them.
This is what HOAs are supposed to prevent.
Can someone tell me what right an HOA has regarding tree’s on property that die? Mine died, and we paid to have it removed over six months ago, and the ground is so riddled with roots, the company that did the removal stated that we should leave the ground alone for a while. The HOA is demanding we replace it with an Oak Tree, when the original was a decorative Pear. Any Thoughts?
Your HOA has or should have Bylaws governing what they can and can’t do, also the HOA rules and guidelines should be very specific as to what they can demand. Ours got changed after the neighborhood was completed and the
builder no longer weighed in.
Read your specific CCR’s. In my HOA CCR’s there is a minimum size specified, and 2 trees per lot, but no mention or restriction as to the tree type. When my Oak tree died I replaced with a Magnolia. Your answer is in your CCR’s.
How much can our HOA increase the dues at one time?
I’m so stressed. A $78,000 special assessment was approved by the HOA that DOESN’T need to be voted on by owners, that’s what they say anyway. Why did I just get a bill for $700 due for a special assessment not even on my building? Also, due by April. Really? Why can they give me a deadline here?
What about our hoa has frozen dues for people over 75 are they a rule now that they can vote in hoa elections and serve on committees

HOA’s need to be disbanded altogether. Never ever should an HOA be able to dictate what happens on or with a property they aren’t paying for. Never, ever should an HOA be able to foreclose on a property over HOA fees when the property itself is up to date with BANK that loaned the money. They don’t keep up with their maintenance. They do nothing for the homeowners. They don’t keep out crime, they don’t increase quality of life, they don’t use the fees to make anything in the neighborhood better.
